Ed Sheeran has been accused of copying Marvin Gaye’s “Let’s Get It On” in his 2014 song “Thinking Out Loud.”

Kathryn Townsend Griffin is suing Ed, claiming to own a partial copyright in Marvin Gaye's 1973 song as an heir of Ed Townsend, who co-wrote it.

On Wednesday, a New York federal judge denied Ed Sheeran's motion to drop the whole thing, shutting down his arguments that the works aren't substantially similar.

In the ruling the judge wrote,"Even without considering the bass-line and drum parts, which are not present in the ‘Let’s Get It On’ deposit copy, the question whether ‘Thinking Out Loud’ infringes on ‘Let’s Get It On’ should be determined by trial rather than summarily.”The judge also notes that a jury “may be impressed by footage of a Sheeran performance which shows him seamlessly transitioning between ‘Let’s Get It On’ and ‘Thinking Out Loud.’”
